Intentional torture with banned loudspeakers by the culprits and Harassment from Police
29.7.2002-Submitted Complaint3a to the Thumba Police, along with the copy of Gazette Notification3b categorizing different zones to implement the Noise Pollution (Regulation & Control) Rules-2000.
The culprits behind the illegal structure were called to the Police Station and asked to reduce the volume and duration of nuisance. They agreed but did not keep the word.
18.11.2002-Submitted another complaint to the Thumba Police. That too could not make any difference. So I have continued complaining to the Police frequently whenever they used loudspeakers.
27.11.2002-In retaliation the culprits planned a defamation trap with the help of corrupt promoted SI (Thumba PS) while one of my close relative was in my home. But failed miserably as the SI could not find any fault.
27.12.2002-Submitted Complaint3c to the City Police Commissioner. And the nuisance from the cone shaped metal loudspeakers (Banned by the Hon. Supreme Court in 2000) was stopped permanently.

The culprits started organizing petty programs to make nuisance any how using box type loudspeakers in odd times and in high volume with the help and support of Police.
4.8.2003-Received summons for a petty case No. 430/02 (IPC 290). This was a false petty case raised on 27.11.2002 by the corrupt promoted SI due to the pressure from the culprits as their defamation trap plan failed miserably. I came to know about this petty case only after receiving the summons without giving me any chance for challenge.
11.8.2003- Submitted Complaints against the injustice of the corrupt promoted SI to the (1) Hon. CM, (2) DGP, (3) City Police Commissioner, (4) Human Rights Commission, (5) Legislative Assembly Petitions Committee, (6) Addl. Director of Police-Inteligence, (7) Asst. Inspector General of Police-Public Grievance Cell, (8) SP Special Cell. And a News in Kerala kaumudi dtd.12.8.2003 page-6 4a And the corrupt SI was transferred to Parassala.

Attack with the support of Police
13.4.2007-In the shield of festival, the culprits have placed two huge illegal loudspeaker boxes intentionally in front of my house to torture me. I have requested them to place it away from my house. As they did not take the boxes away, I have made a complaint to the Thumba Police and they were not interested in helping me and I have reported the matter to the ACP Shanghumugham and the loudspeakers were shifted to another location.
15.4.2007-In retaliation I was attacked by the culprits with the support of Police. Police were reluctant in taking FIR or taking my statement from Medical College Hospital where I was admitted for observation.
17.4.2007-Submitted complaint to the Hon. CM in connection with the assault.
24.4.2007-The complaint to the Hon. CM was forwarded to City Police Commissioner. Then to the CI Medical College and some politicians intervened without any party difference to help the culprits. I did not succumb to their request/pressure and stood firmly for registering the Case No. CC-753/2007. The Police put all efforts to defeat the case to save the culprits.

Received RTI Act Reply No. 6/09 dtd. 5.12.2009. This revealed that, the land in which the unauthorised structure was constructed belongs to the Government.

8.1.2010-Submitted RTI Act Application10a to the SPIO, KSEB, Kulathoor Section.
Received RTI Act Reply No. RIA/PIO/KLR/2009-10/217 dtd. 25.1.2010. This revealed that, the electric supply was given illegally without submitting any necessary documents, and the KSEB disconnected the supply on 5.3.2010.
19.4.2010-The illegal electric supply was restored after 45 days, by using unlawful methods with the involvement of corrupt higher officials.

KSEB officials sent me a reply with false statements and unwanted documents and escaped cleverly. Review was not entertained by SIC to help the corrupt officials. This defect in the RTI Act has to be corrected. After hearing Appeal-2, the information commission should ask CPIO/SPIO/Appellate authority to submit the information to the commission to ensure the information provided by them is in accordance with what they admitted during hearing, and send it to the applicant only if the information is correct.

19.2.2011-Unnecessary abuse at 3pm by the accuse No.1 of the case No. CC-753/2011.
22.2.2011-Asked the Asst. Engineer, Electrical Section, KSEB, Kulathoor, Trivandrum to take action against this illegal connection, but he was insisting me for a written complaint with the intention of creating a controversy and said "if I want I can disconnect, not disconnect or create even a controversy".
26.2.2011-Filed a Corruption Case12a (506/2011 C) before the Hon. Kerala Lok Ayukta Court. This revealed more irregularities, and Govt. officials of KSEB and Trivandrum Corporation struggling to defend corruption using Govt. machineries.
2.7.2011-Submitted RTI Act Application12b to the SPIO, KSEB Kulathoor Section asking the copies of notices served to the consumer regarding producing the proof of ownership.

17.11.2011-Submitted Complaint17a to the ACP Shanghumugham, Trivandrum and FIR(698/2011) was registered against Haridas and Salini, first time in history for making nuisance with loudspeakers in the illegal structure without permission from Police. This nuisance was in the shield of Makaravilakku in Sabarimala. The FIR was registered in accordance with the RTI Act Reply Report No. 1524/RTI Act/ACS-11 dtd. 16.8.2011.

When a new SHO took over the charge of Thumba Police Station, the culprits got the keys back with corrupt methods. I have questioned it immediately and the SI could not give reply in time and was imposed with a fine of RS.1250 by the State Information Commission. Even though the SPIO was imposed with a fine, none of my 6 questions were answered correctly. The SPIO and Appellate authority were absent on hearing without any reason, My questions were rewritten and diluted by the SIC to save the Police. Police even sent me false reply and fake certificate managed from Attipra Village Office and escaped from the trouble.

CPIO's Email reply27b after a month stating that, my application is defective. This was an absolute LIE just to escape from providing information sought by me.

The whole procedure was suspicious and as an Ordinary Citizen of a Democratic Nation, I felt that, the CPIO is above Law and RTI Act-2005 Rules. Over and above the Hon. CIC was in support of the injustice.
(1) The CPIO send an Email message after specified time limit of 30 days with a fabricated lie that my Application is defective as the Indian Postal Order (as fee) was not received, If the allegation was true, she should have sent the message as soon as my RTI Application was received. But she took one month time to invent the alleged defect.
(2) The CPIO never bothered to mention about the EMO (as fee) which I send again.
(3) The CPIO send another Email message without signature and seal, after 2 months with another excuse that, my application is not covered under Section 2(f) of the RTI Act-2005.
(4) The Appellate authority sent a reply after 2 months and it mentioned only about the non receipt of Indian Postal Order and nothing on the Section 2(f) excuse of the CPIO or about my EMO.
(5) Now the Hon. CIC have said nothing about the specific time limit for replying by the CPIO and Appellate authority, and RTI Section 2(f) has been interpreted wrongly to save the CPIO from penal action.

Blackmail tactics to use loudspeakers illegally in the illegal establishment
9.4.2014-Submitted Application32a to the City Police Commissioner, Trivandrum. This is to block the use of loudspeakers illegally by the culprits, when ever the new Police officer assume charge.
The culprits pressurised me to withdraw the complaint and demanded a no objection letter, so that they can get Mike order from Police. But I did not succumb to their pressure.
12.4.2014-At around 4pm, a Police man came with two petitions filed against me by the culprits. The petitions were not read out to me, all he pronounced was few hints. This was a conspiracy to blackmail me for using loudspeakers illegally on 14 & 15.4.2014.
12.4.2014-Submitted an application by Email to SI Thumba, and copies to CP Trivandrum, ACP Shanghumugham, CI Medical College, with all true facts, requesting to reject the petitions unconditionally, as they are fabricated and false with the intention to cheat, blackmail and make me compromise for using the loudspeakers illegally.
Till date no action has been taken upon the petitions filed by the culprits, but the Police allowed them to use loudspeakers illegally.

In this case the hearing was held on 2.5.2013 through Video-Conferencing. During the hearing, when the CIC Chief got annoyed and pulled up the DD officials, the CPIO admitted before the Hon. CIC that, the Doordarshan has carried the Advertisement, but when she gave the written reply to me she has cleverly denied it. This defect in the RTI Act has to be corrected. After hearing Appeal-2, the information commission should ask CPIO/SPIO/Appellate authority to submit the information to the commission to ensure the information provided by them is in accordance with what they admitted during hearing, and send it to the applicant only if the information is correct.
